The owners of the Empire State Building say a sperm-bank tenant is discarding hazardous material, including nitrogen and radioactive substances.
Now Daxor Corp. is suing to prevent its eviction, saying it meets all waste-disposal regulations.
Daxor, once the state’s largest sperm bank, was shut briefly in the ’90s after repeatedly breaking state health and safety codes.
Building reps did not return messages.
