A stagehand on the Times Square promotional set for the superhero flick “Justice League” plans to sue the city for $10 million after she tumbled 20 feet from a structure supporting the Batmobile.
Rene Andino was climbing a truss on Broadway between 42nd and 43rd streets on Oct. 4, 2017, to hang a banner for a production promotion where the Batmobile and other movie props were to be displayed.
But while she was ascending the structure, her harness suddenly snapped and she crashed to the ground, she says in Manhattan Supreme Court papers.
She was not provided with a safety line, net or spotter, according to court papers.
She was knocked unconscious and rushed to Bellevue Hospital with head trauma and fractures of the left wrist, pelvis and pubic bone, according to court papers.
The freelance stagehand was working for KM Productions NY Inc. at the time through her union, Theatrical Stage Employees Local One. But she wants to bring a state Labor Law claim against the city because the plaza where the incident occurred is public property.
Her attorney did not return calls requesting comment.
A spokesman with the city’s Law Department said, “We’ll review the legal papers.”
She needs special permission to file the suit because she missed a deadline. Shortly after the accident, she was jailed in Pennsylvania for an old, oustanding drunk-driving conviction.
