The case of the Long Island man accused of fatally shooting the co-owner of the Spumoni Gardens pizzeria was transferred from federal to state jurisdiction Monday, authorities said.

The Brooklyn DA’s Office has taken over the prosecution of Andres “Andy” Fernandez, whose lawyer, Lawrence Wright, pleaded not guilty for him in Brooklyn Supreme Court.

Fernandez, 40, of Melville, is accused of gunning down Louis Barbati, 61, as the restaurateur arrived at his Dyker Heights home in June, carrying a loaf of bread and $15,000.

Sources said the case transferred jurisdictions because the crime did not constitute a federal offense.
