A Brooklyn man is suing the makers of Yoo-Hoo for $5 million over its claim that the chocolate-flavored drink is “good for you,” when it really contains “dangerous, unhealthy, non-nutritious, partially hydrogenated oil,” according to court papers.

The distributor, the Dr. Pepper Snapple Group, dismissed Timothy Dahl’s suit as “trivial.”

“Yoo-Hoo is a perfectly safe, fun treat,” said a spokesman for the firm, adding, “We stand by our product.”
