Corey PohanSteven HirschManhattan prosecutors have dismissed an assault rap against a self-described international surfer “with sick six-pack” abs for decking a Hell’s Kitchen dog walker last summer.
Corey Pohan, who wasn’t in court, cold-cocked bartender Paul Martone in a spat over the surfer having stepped over Martone’s cute Chihuahua, Peanut.
But it turned out that Martone was the aggressor in the dust up, according to law enforcement sources.
Prosecutors said they couldn’t prove the case beyond a reasonable doubt.
Pohan still faces disorderly conduct rap for trying to flee cops after he was arrested in NJ on the assault case.
