Holdout tenants of the Chelsea Hotel are suing to cement its status as an apartment building for permanent residents.

The suit is a Hail Mary pass by five lucky New Yorkers who hold coveted rent-stabilized leases at the West 23rd Street landmark.

The building’s new owners, Ira Drukier and Richard Born, are transforming it into an upscale hotel and condo with a bar and spa.

Drukier and Born have given the Victorian Gothic building a major renovation, according to the Manhattan Supreme Court suit.

But the long-term residents — including Jonathan and Susan Berg, who’ve lived there since 1975 — claim their new landlord never got a proper certificate of occupancy.

“As an apartment building, the building is a single-room-occupancy dwelling that is occupied for permanent residence purposes,” the suit says.

An attorney for the landlord did not return messages seeking comment.
