A New Jersey college student who was exchanging text messages with her boyfriend right before he crashed into a motorcycling couple won’t be held responsible for the accident, a judge ruled yesterday.

Motorcycle enthusiasts David and Linda Kubert, both 59, lost their left legs in the horrific 2009 accident when they were plowed by distracted driver Kyle Best as they rode through Mine Hill, NJ.

Best — who pleaded guilty to distracted driving — had been texting his girlfriend, Shannon Colonna, right before he struck the Kuberts. The couple’s attorney, Skippy Weinstein, added Colonna as a defendant in a civil suit seeking damages for the crash.

But Judge David Rand disagreed with placing blame on Colonna, granting her motion to be removed from the case.

Weinstein said the Kuberts were disappointed by the judge’s decision but were gratified by the attention the case has brought to the dangers of texting while driving.

“Perhaps it may prevent another tragic accident from occurring,” he said.
