A New Jersey judge will soon decide whether a woman who texted a 19-year-old friend can be held liable for a car crash the friend caused while reading the message.

Two Dover residents injured when the young man hit their motorcycle in September 2009 filed suit, The Daily Record reported. The teen was given three tickets and pleaded guilty this year.

The suit claims the woman aided and abetted the motorist’s negligence by texting him when she knew or should’ve known he was driving. Her lawyer says she had no control over when the message would be read.
