The city discriminates against transgender people by making them jump through hoops to amend their birth certificates, a new lawsuit charges.

While the city health code says a “new birth certificate shall be filed” when a person undergoes a sex-change operation, the city Department of Health and Mental Hygiene requires way more, the Manhattan suit claims.

Leonard Birney, 70, who underwent female-to-male gender-changing surgery in May 2009, is challenging demands that he also turn over his complete surgical record and undergo a post-operative psychiatric evaluation.

“Why do they need a psychiatric evaluation?” Birney’s lawyer, Yetta Kurland, asked. “It’s bizarre.”

In response, the city says it is concerned about the misuse of birth certificates.
