Rape charges against a baby-faced Irish bartender accused of attacking a tourist were dropped yesterday after the alleged victim told prosecutors she would refuse to testify against him.

But the barman, Damien McGuinness, 22, remains locked up as he awaits deportation to Ireland for having overstayed his tourist visa.

“My client’s thrilled,” said McGuinness’ lawyer, Wyatt Gibbons, after the case was dismissed in Manhattan Criminal Court.
