First he cried poverty, and now disgraced former Assemblyman Vito Lopez is playing the sick card in a pending federal sexual-harassment lawsuit accusing him of groping two female underlings.

Lopez was expected to give a deposition next month but recently informed former aides Victoria Burhans and Chloe Rivera that he won’t be available to be deposed until at least Jan. 8 because of “medical reasons,” according to papers filed last week by plaintiffs’ lawyer Kevin Mintzer.

The cancer-stricken former Brooklyn Democratic boss was so concerned about the public learning that he was seeking the delay due to his health that he sought a court order to have Mintzer’s letter redacted or filed under seal. Judge Analisa Torres denied the request.

Mintzer told The Post, “It’s clear to me that [Lopez] would like to delay the deposition as long as possible, although I don’t doubt what [Lopez’s lawyers] said about his medical condition is true.”

Mintzer declined to discuss his private briefing about Lopez’s health. Lopez’s lawyer Laura Sack declined comment.
