Disgraced Hollywood producer Harvey Weinstein has been indicted on new charges by a Manhattan grand jury ahead of his highly anticipated second sex crimes trial in the city, prosecutors said Thursday.

“The Grand Jury has indicted Mr. Weinstein,” said Manhattan Assistant District Attorney Nicole Blumberg in a morning court hearing.

“We have not unsealed the actual indictment so we won’t speak about the specifics.”

The new indictment will add charges to Weinstein’s pending sex crimes trial – a proceeding that follows his original conviction and 23-year sentence being overturned in April.

Weinstein’s attorney, Arthur Aidala, said outside at a press conference that he believes the new indictment will have three new accusers bringing forth sex crimes against the ex Miramax honcho, who was not in court due to a recent health scare.

The new complaints, according to the attorney, happened during a five-month period in the winter of 2005 to 2006; a separate matter in April or May of 2006; and another complaint in 2016. But specifics details aren’t yet known.

“I don’t anticipate them being misdemeanors. I anticipate them being serious felonies,” Aidala said.

Weinstein remains hospitalized at Bellevue Hospital where he underwent emergency open-heart surgery after experiencing chest pains and being rushed out of Rikers Island earlier this week.

His attorney revealed Weinstein “almost died” due to his latest health scare before he was rushed to the hospital.

“He has sort of a shunt in his chest which is attached to a bag which is draining fluids from his body,” Aidala told the court.

Manhattan Supreme Court Judge Curtis Farber ruled that Weinstein will be allowed to remain at the hospital indefinitely instead of being shuffled back to Rikers Island where he’s been locked up since 2020.

The judge ordered the attorneys to report back to court with a medical update on Sept. 18.

If Weinstein is able to appear in person for the court date, he will be arraigned on the new indictment, according to his attorney.

Prosecutors have said that Jessica Mann, who Weinstein was convicted of sexually assaulting, is prepared to testify against him in the new case. Another accuser, Mimi Haley — who had testified Weinstein forcibly performed oral sex on her at the 2020 trial — has said she would “consider” testifying again at the new trial.

“The significant new criminal charges leveled today against Harvey Weinstein show that this Grand Jury, like so many others, can see clearly through his facade for what he truly is: a predator who must be held accountable for his crimes,” Mann said in a statement.

The second trial was expected to unfold in November, but the judge wondered aloud Thursday whether it was “premature” to think that it could still happen then, given Weinstein’s health problems.

“We will be ready for trial with our new survivors on November 12,” Blumberg shot back.

Aidala argued the new indictment should be “separate” from the previous indictments on which prosecutors planned to retry Weinstein.

“We don’t have a name. I don’t want to repeat myself, but I know that the bottom line is we ethically, ethically — we cannot be ready ethically,” Aidala said.

Weinstein had his Manhattan 23-year-sentence tossed in April when New York’s highest court found that the trial judge allowed testimony from three women whose allegations weren’t directly tied to the case.

He remains held at Rikers Island in a separate Los Angeles conviction for raping an Italian model at a film festival in 2013.

Weinstein will be sent to a California prison after his Manhattan retrial after officials pushed for his extradition.
