A private music teacher in New York admitted giving a young girl foot massages for years to please himself sexually — but will dodge jail after pleading guilty to the sick crimes.

Michael Waite, 42, pleaded guilty Monday to course of sexual conduct against a child after a jury could not reach a verdict during two days of deliberations. A judge promised Waite, who runs a music studio in East Syracuse, 10 years’ probation if he admitted to the felony. A jury did find him guilty, however, of endangering the girl’s welfare, Syracuse.com reports.

Waite, of Mattydale, will also be required to register as a sex offender after admitting that he gave the girl erotic foot rubs for more than seven years, beginning when she was very young. Waite used the girl’s feet to touch his genitals repeatedly during the massages, she told police.

Waite’s attorney, David Zukher, previously claimed that the girl concocted the allegations to harm Waite and noted that police found no physical evidence during their investigation, characterizing the case as a “he said, she said” matter with no proof.

Prosecutor Jordan Aiello, however, argued that the massages would not have created any physical evidence that could be obtained by investigators and said there’s no evidence Waite did anything other than having the girl’s feet touch his genitals.

Waite, according to trial testimony, repeatedly denied sexually abusing the girl, but acknowledged giving her foot rubs in text conversations and during a wiretapped police interview, Syracuse.com reports.

Waite had faced roughly 10 years in prison if convicted of sexually abusing the girl, who was not a student at his music studio. She did not accuse Waite of any other additional sexual contact during her testimony.
