Pentagon funds that President Trump wants to use for a border wall will remain frozen, a San Francisco appeals court ruled Wednesday.
The divided three-judge panel of the 9th US Circuit Court of Appeals agreed with a May lower court ruling that halted the administration’s efforts to use $2.5 billion in Defense Department funds for the planned construction of 51 miles of fencing along the US-Mexico border.
Trump immediately vowed to appeal the ruling.
The freeze was initially imposed by US District Judge Haywood Gilliam Jr., who wrote in a ruling that Congress’ control of federal purse strings is an “essential” feature of the Constitution.
The blocked money was part of $8.1 billion in funds that Trump rerouted for border wall construction under his February national emergency declaration — including $3.6 billion from military construction funds and $600 million in Treasury Department funds.
