Nathan Wade’s former law partner and divorce attorney was ordered by a judge Monday to retake the witness stand and testify about the timeline of the alleged intimate relationship between his client and Fulton County District Attorney Fani Willis. 

Attorney Terrence Bradley is alleged to have direct knowledge that Willis and Wade were already in a relationship when his client was hired by the district attorney to be the special prosecutor in former President Donald Trump’s Georgia election interference case. 

Bradley, during a Feb. 15 hearing, refused to answer questions about the DA and the special prosecutor’s relationship, citing attorney-client privilege between him and Wade. 

Judge Scott McAfee ruled Monday that the divorce lawyer and his counsel “did not meet their burden of establishing that the communication(s) are covered by attorney-client privilege and therefore the hearing can resume as to Mr. Bradley’s examination,” according to CNN.

Bradley could take the stand as early as Tuesday, according to the outlet. 

Trump and several of his co-defendants are seeking Willis’ disqualification from the case and to have all charges against them dismissed over the alleged relationship, arguing that the DA benefited financially from the alleged romance and that it compromised the integrity of the case.

Lawyers for Trump recently revealed that dozens of pings from Wade’s cellphone indicate that the special prosecutor made overnight trips to Willis’ rented condo and communicated with the DA earlier than they have both have previously testified that their relationship began.

• Fulton County, Ga., District Attorney Fani Willis is being accused of misusing state and federal funds, and also engaging in an “improper” relationship with special prosecutor Nathan Wade.
• Willis admitted to having a “personal relationship” with Wade, but said it didn’t become romantic until after 2022 due to the case against former President Donald Trump.
• Willis hired Wade to work on the Trump case and paid him $654,000 in 2022, according to Trump co-defendant Michael Roman.
• Trump and his co-defendants are looking to disqualify Willis from the case and to have all charges, centered around the state’s expansive anti-racketeering RICO law, dismissed.
• The defense has presented dozens of pings from Wade’s cellphone that placed it at Willis’ rented condo prior to 2022. A former friend of Willis, who owned the condo, has testified that she saw the two of them “hugging” and “kissing” in 2019.
• On March 15, a judge ruled Willis can stay on and prosecute the Georgia election interference case against Trump and his co-defendants for allegedly trying to overturn the results of the 2020 election — if Wade steps aside.

McAfee will decide on whether to allow the cellphone data as evidence at a Friday hearing, according to Fox News. 

Court documents from Trump’s team claim that Wade visited Willis’ condo at least 35 times before he was hired for the case. 

Wade testified last week that he made no more than 10 visits to the property before his November 2021 hiring. 

Both Willis and Wade assert that their relationship began in early 2022.
