A Georgia judge yesterday said rap mogul Usher can keep custody of his 5-year-old son despite a near-tragic swimming pool accident this week.

The judge dismissed an emergency motion filed by his ex-wife seeking temporary custody of the child, saying it was not an emergency or crisis situation.
